DATE: OCTOBER 04, 2021 P.C.:- 1] Applicant is seeking regular bail in Crime No.707 of 2020 registered with Andheri Police Station, Mumbai for the offence punishable under Sections 420, 376, 504, 506 of the Indian Penal Code.

2] Prosecution case is, Applicant neither returned the amount of Rs 5 lakhs accepted in cash, nor honoured commitment of providing a room. Under the pretence of return of the amount, Applicant has committed sexual assault on the complainant.

4] Apart from the fact that the allegation of handing over of Rs 5 lakhs to the Applicant is not supported by any documentary evidence, there is no medical evidence on record justifying the accusation of sexual assault. That being so, Applicant deserves to be released on regular bail.

5] Applicant is directed to be released on bail in Crime No.707 of 2020 registered with Andheri Police Station, Mumbai for the offence punishable under Sections 420, 376, 504, 506 of the Indian Penal Code on furnishing P.R. Bond in the sum of Rs 25,000/- with one or more sureties in the like amount. Applicant shall neither tamper with the evidence nor directly or indirectly try to influence the prosecution witnesses and the complainant.
