The learned counsel appearing on behalf of the Petitioners Shri Prashant Beri states that in view of the supervening event of the suit itself being dismissed for non-prosecution, the above Petition challenging an interlocutory order passed therein has turned infructuous. The above Petition is accordingly disposed of as having turned infructuous. In the event the suit is restored, the Petitioners would be at liberty to apply for restoration of the above Writ Petition.
