By this Application under Section 115 of the Code of Civil Procedure, 1908, applicant, hereinafter referred to as defendant No.1, has challenged the judgment and order dated 08.03.2013 passed in S.C.Suit No.2153 of 2012. By that order, the learned trial Judge held that the Suit is not barred in view of Section 164 of the Maharashtra Cooperative Societies Act, 1960. 3.

Mr. Pawar states that on 17.10.2015, plaintiffs have withdrawn the Suit. He, therefore, states that this C.R.A does not survive and it may be disposed of as infructuous.

In view thereof, C.R.A. is disposed of as infructuous. Order accordingly.
