This is an application for direction to the Respondent No.3 i.e. Passport Authority to consider the Applicant's application for re-issuance of passport for a period of ten years. This Criminal Appeal is of the year 2018. The Applicant was tried for the offences punishable under Sections 7, 13(2) read with 13(1)(d) of the Prevention of Corruption Act, 1988 (hereafter "P.C. Act", for short) in Special Case No.66 of 2015 before the Special Judge. The Applicant was convicted for the offence punishable under 1/2

PMB 902.ia.1617-23.doc Section 7 of the P.C. Act and sentenced to suffer rigorous imprisonment for three years and pay fine. The Applicant was convicted for the offence punishable under Section 13(2) read with 13(1)(d) of the P.C. Act and sentenced to suffer rigorous imprisonment for four years and pay fine. The Applicant's passport has expired.

Mr. Kuldeep S. Patil, learned counsel for Respondent No.2 and Mr. S. K. Halwasia, learned counsel for Respondent No.3 opposed the Application.

My attention is invited to the provisions of Section 6(2)(e) of the Passports Act, 1967. In my opinion, there is no impediment for the Respondent No.3 to consider the Applicant's application for re-issuance of passport for a period of five years as this Appeal is likely to take some time to be heard.

In the event the passport is renewed, the Applicant shall not travel abroad without the leave of this Court. 5.

Interim Application is disposed of.
