Learned APP has filed the report contending therein that in the present case i.e. Sessions Case No. 363 of 2017, charge was framed on 18/6/2018 and today i.e. on 14/8/2018, substantive evidence of complainant was to be recorded. It also appears from the index of the charge-sheet that the prosecution has enlisted 14 witnesses whose evidence is to be recorded. Learned APP submits that the prosecution Talwalkar
901.ba916.18.doc may not examine 2 to 3 witnesses on the same point. In view of this, learned Sessions Court shall expedite trial and conclude recording of evidence as far as possible by 30/1/2019.
In view of the aforesaid observations, the learned Counsel for the applicant seeks liberty to withdraw the application. The liberty as prayed for is granted. The application stands dismissed as withdrawn and hence, disposed of accordingly.
