Sole appellant by this appeal is challenging his conviction and sentence imposed on him by the learned 4th AdHoc Additional Sessions Judge, Nashik, for the offence punishable under Section 302 of the Indian Penal Code. The learned APP has submitted report from the Senior Police Inspector, Devlali Camp Police Station, Nashik City, dated 9th July 2019, communicating to avk 1/2

Photocopy of the certificate issued by the Registrar under Sections 12 and 17 of Registration of Births and Deaths Act, 1969, is also annexed to the said report. The Report is marked "Exhibit Y" for the purpose of identification. Even the learned counsel for the appellant has produced on record photocopy of Death Certificate of the sole appellant. The learned counsel for the appellant submits that the appeal be ordered to be abated. In view of death of the appellant, the appeal stands abated and is consigned to Record.
