Heard. Issue notice to the respondents. Mr Aabad Ponda, learned Senior Counsel, waives service of notice on behalf of respondent no.1.

The applicant (original accused in C.C. No.5800134 of 2021) seeks cancellation of non-bailable warrant issued against him by the learned Metropolitan Magistrate, 58th Court, Bandra, Mumbai.

The learned Counsel for the applicant fairly submits that the applicant is not evading his appearance and intends to be present in the trial court on 13 June 2024 positively, and file a fresh application seeking cancellation of non-bailable warrant. The learned Counsel also states on instructions that the applicant will provide correct residential and office address to the learned trial court and will co-operate for the expeditious disposal of the case.

The learned Magistrate shall consider the said application, on its own merits and decide the same in accordance with the law. The execution and implementation of the order dated 11 August 2022 and 8 March 2023 is stayed upto 13 June 2024. The present criminal application stands disposed of accordingly.

Since the case is pending for last three years, the learned trial court is requested to expedite the hearing of the trial and to dispose of the same as far as possible within six months from the date of receipt of this order.
