This is an application by an alleged witness in CR No. 125/2016 dated 12/3/2016 registered with Borivali Police Station, Mumbai. The applicant is neither the complainant nor the informant. As stated earlier, the applicant claims to be a witness in the said crime. It is imperative on the part of the applicant to first record his statement with the concerned investigating agency, produce the necessary and relevant documents before it in support of his contention and assist the investigating agency as contemplated under the provisions of law. The applicant, according to me, has no locus-standi to intervene in the present application by raising a specious plea that the applicant is one of the victims of the applicant in ABA No. 749/2016 and for the first time submit the documents before this Court for either adjudication or placing reliance on it. If the applicant chooses to do so, he is at liberty to approach the concerned investigating agency and record his statement. The application being misconceived is dismissed in limine.
