Applicant is seeking his enlargement on bail in connection with the Crime No.002 of 2018 registered at Shikrapur Police Station, Pune for the ofences punishable under Sections 143, 147, 148, 149, 302 of the Indian Penal Code, 1860 along with Section 37(1), 35 of the Maharashtra Police Act, 1951.

The learned counsel for the applicant seeks his enlargement on bail on parity in-as-much as this Court vide order dated 26th November, 2019 passed in Bail Application No.697 of 2019 with Bail Application No.1542 of 2019 had directed to release accused nos.2 and 3 on bail.
I have perused the order passed in the aforesaid two bail applications.
The learned APP on instructions from the Investigating Ofcer, who is present in the Court, fairly submits that role attributed to this applicant is the same as attributed to the accused nos.2 and 3. Additionally, he submits, this applicant had also shown the place of the incident.
In view of the facts of the case and in view of the order passed by this Court directing release of the accused nos.2 and 3 on bail and also in view of the fact that the role attributed to this applicant is similar which Shivgan 2/4
has been attributed to the accused who have been released on bail, application is, therefore, allowed. Hence, the following order:
ORDER
(i) The applicant be enlarged on bail in Crime No.2 of 2018, registered with Shikrapur Police Station, on executing PR Bond in the sum of Rs. 25,000/- with one or two sureties in the like amount;
(ii) The applicant shall attend the concerned Police Station once in a month on the frst Saturday of every month between 10:00 a.m. to 12:00 noon, till further orders; (iii) The applicant shall not tamper with the evidence or attempt to infuence or contact the complainant, witnesses or any person concerned with the case and shall attend the trial Court on the date of hearing of the matter; The application is accordingly allowed and disposed of.
It is made clear that observations made hereinabove Shivgan 3/4
be construed as expression of opinion only for the purpose of granting bail and the same shall not in any way infuence the trial in other proceedings.
