This application under Section 439 (2) of the Code of Criminal Procedure, is by applicants, who had booked flats with respondent No.2. It is seen that on the basis of report lodged by one Prakash Raut, Crime No.294 of 2012, came to be arrested against respondent No.2, at Police Station, Kalamboli, Navi Mumbai. In that offence, respondent No.2 came to be arrested.

From the record, it is seen that charge sheet against respondent No.2 was not filed within a period of 60 days. The learned Judicial Magistrate Firs Class, Panvel, was pleased to release respondent No.2 in 1/2

29 APPLN 271 OF 2015.doc exercise of powers under Section 167(2) of the Code of Criminal Procedure.

Nothing is pointed out to show that order granting statutory bail to respondent No.2 is perverse and or illegal. In this view of the matter, the application is rejected.
