2 906.939.15 ba completed and charge-sheet is filed in the last week on 23/06/2015 i.e. after filing of present application. In view of this, learned counsel for the applicant, upon instructions seeks liberty to withdraw the application with further liberty to approach Sessions Court under section 439 of Code of Criminal Procedure, 1973 in the changed circumstances.

2) Liberty as prayed for is granted in the interest of justice. Application stands dismissed as withdrawn. Learned Sessions Judge shall consider the application on its own merits without being influenced by the withdrawal of this application as it is not heard on merits. In view of the withdrawal of bail application, nothing survives in the intervention application, hence disposed of accordingly.
