This is an Application for pre-arrest bail as the applicant-accused is prosecuted for offences punishable under sections 498A, 406, 323, 504 r.w 34 of the Indian Penal Code in C.R. No.172 of 2015 at Samata Nagar Police station, Mumbai registered on 13.4.2015. It is the case of the prosecution that the complainant got married with the applicant-accused on 17.4.2009. There are two children out of the wedlock. However, it is the case of the applicant-accused that her in-laws used to harass her and on 13.2.2015, he forced her to write that she did not want to stay and wanted to go to her native place. However, her ornaments were taken away by her husband and mother-in-law. So, she gave the complaint. 1 / 2

The learned Counsel for the Applicant has submitted that the applicant-accused has deposited Rs.35,000/- in the police station. She submitted that the applicant-accused wants to stay with the complainant and his children.

The learned Prosecutor submitted that the dispute mainly appears to be in respect of ornaments and as Rs.35,000/- is deposited with the police and his custody is not required.

In the circumstances, the interim bail granted earlier is hereby confirmed on the same terms and conditions with a modification that the applicant-accused shall attend the concerned police station as and when required. The applicant-accused shall also not pressurise or harass the complainant or her family members. The police is directed to deposit the amount of Rs.35,000/- deposited by the applicant-accused with them in the trial Court at the time of filing of chargesheet. 5.
