At the out set, the learned APP. submitted that during the pendency of the present application the police have submitted charge sheet before the Trial Court. The present application for cancellation of anticipatory bail on merits therefore does not survive.

Mr. Chavan, the learned counsel appearing for the applicant submitted that, apart from the challenge to the impugned order on merits the applicant has also pleaded that the respondent No.2 has committed breach of conditions imposed upon the Respondent No.2 by Order dated 22.8.2016 passed in ABA No. 1183 of 2016 by the

In view thereof, the applicant is granted liberty to file an application under Section 439(2) of Cr.P.C. for cancellation of bail on the ground of breach of conditions before the learned Additional Sessions Judge, Greater Mumbai.

Application is accordingly disposed off.
