This is an application for modification of order dated 22nd March, 2022 passed by this Court in Criminal Application No.1455 of 2019.

The sentence of imprisonment was suspended and the applicant was directed to be released on bail on executing P.R. bond in the sum of Rs.20,000/- with one or more sureties in the like amount.

The applicant was permitted to furnish cash bail in the sum of Rs.20,000/- for a period of eight weeks in lieu of sureties. 5.
Learned Advocate for the applicant submitted that the applicant is not in a position to make arrangement for surety and hence, the applicant may be released on permanent cash security. by SAJAKALI LIYAKAT JAMADAR Date:

Learned APP submitted that the applicant is from Bihar. Permanent cash bail may not be granted to the applicant. Vide order dated 22nd March, 2022 the applicant was granted bail and for temporary period of eight weeks he was permitted to furnish cash bail. It appears that the applicant has not furnished cash bail on account of financial constraints. 7.
Dispensing with furnishing surety is not possible. Prayer for permanent cash bail cannot be granted to applicant.
ORDER
i.
Order dated 22nd March, 2022 passed by this Court in Criminal Application No.1455 of 2019 is modified and the applicant is directed to be released on bail on executing P.R. Bond in the sum of Rs.15,000/- with one or more sureties in the like amount;
ii.
The applicant is permitted to furnish cash bail in the sum of Rs.10,000/- for further period of eight weeks in lieu of surety from today.
iii.
