The learned APP, on instructions, submits that the trial pertaining to CR No. 273/2013 registered with Gavdevi Police station, Mumbai has already began. She further submitted that as of today two witnesses have been examined by the prosecution and PW 3 i.e. the prosecutrix is in the witness box. She further submitted that the prosecution may examine five more witnesses in support of its case. Taking into consideration the aforesaid fact, the learned counsel for the applicant seeks leave to withdraw the present application with liberty to file a fresh bail application if the trial pertaining to CR No.273/2013 registered with Gavdevi Police Station does not conclude within a period of six months from today. Leave and liberty granted. The application is dismissed as withdrawn.
