By this First Appeal, the Appellant is challenging the Judgment and Decree dated 05.01.2012 passed by Bombay City Civil Court at Mumbai in S.C.Suit No. 1887 of 2008 dismissing his suit for declaration that the Respondent/Original Defendant carried out additions, alterations in his flat which is unlawful, illegal and bad in law and also directing the Original Defendant to restore the original position of the flat as per sanctioned plan of the Brihan Mumbai Municipal Corporation.

Considering the submissions made by the learned Counsel for the Appellant and the Judgment and Award, I am satisfied that Appellant has made out a case for following Sneha Chavan 1/2
