At the outset, learned A.P.P has raised an objection. He states that the applicant ought to have filed an application before the learned Special Judge under the Protection of Children from Sexual Offences Act, 2012, Mumbai, seeking modification of the order dated 18th February, 2015 i.e. for reduction of the bail amount.

In view of the objection raised by the A.P.P, learned Counsel for the applicant seeks leave to withdraw the application, with liberty to file an appropriate application seeking modification/relaxation of the order dated 18th February, 2015 i.e. for reduction of the surety amount. SQ Pathan 1/2

It is made clear, that this Court has not considered the application on merits. If the application seeking modification of the order dated 18th February, 15 is filed, the same shall be decided on its own merits in accordance with law, uninfluenced by the withdrawal of this application. 4.
