1] Heard learned counsel for the petitioner and respondent. 2] It is submitted by both parties that without prejudice to the rights and contentions of the parties, the members of petitioner union in W.P. No.11502 of 2018 can also accept the settlement arrived with individual workmen as per settlement dated 30.04.2013. 3] Learned counsel for petitioner union will apply for 1/2

22 WP 11502 OF 2018 extending the benefits of the settlement within a week from the date of this order and the respondent company thereafter within four weeks will make the payment.

4] Accordingly both the Writ Petitions are disposed off. The impugned order passed by the Tribunal is set aside. 5] It is made clear that all the contentions raised by both the parties are expressly kept open.
