Heard learned counsel appearing for the Petitioners. He states that without prejudice to the notice which is subject matter of this Petition, a fresh notice dated 27th January 2014 was served by the Petitioners under Section 127 of the Maharashtra Regional and Town Planning Act, 1966 to the First Respondent. He states that the Petitioners want to file a fresh Petition based on the said fresh notice.

Accordingly, on the prayer of the learned counsel appearing for the Petitioners, we dispose of the Petition as withdrawn with liberty to file a fresh Petition on the basis of the notice dated 27th January 2014.
