Heard rival arguments on the application for bail during pendency of appeal. The applicant is convicted for the offence punishable under Section 8 of the Protection of Children from Sexual Offences Act, 2012 and is sentenced to suffer RI for three years and to pay fine of Rs.5000/-. Reportedly, fine amount is paid. During the trial the applicant was on bail. As such, considering the nature of offence and the imprisonment given, during the pendency of the appeal, the applicant is directed to be released on bail. The applicant shall be released on same bail as granted by the trial Court with fresh bonds to be executed before the trial Court. Accordingly, application is disposed of.
