IN THE HIGH COURT OF JUDICATURE AT BOMBAY

CRIMINAL APPELLATE JURISDICTION ANTICIPATORY BAIL APPLICATION NO. 1041 OF 2024 Geeta Mohan Malkekar ..Applicant

Versus

The State of Maharashtra ..Respondent _____ Mr. Rahul D. Salve for Applicant.

Smt. M. H. Mhatre, APP for State/Respondent.

_____ CORAM :- SARANG V. KOTWAL, J.

DATE :- 17 APRIL 2024 P.C. :- 1.

The Applicant had earlier filed A.B.A.No.833 of 2024 for anticipatory bail in the same subject matter i.e. C.R.No.61 of 2024 registered at Pimpri police station. The matter was fully argued and the following order was passed on 28.03.2024: "1.

After arguing for some time, when I expressed my disinclination to grant relief in this application, learned Counsel for the Applicant prays for unconditional withdrawal of this Application.

2.

Permission is granted. The Application is allowed to be withdrawn unconditionally. If the Applicant is arrested and she prefers an application for regular bail, it shall be decided on its own merits in accordance with law and as expeditiously as possible without being influenced by this order. The Application is disposed of accordingly."

In spite of that order, within one month another application for the same relief is made. There is sanctity attached to the prayers made before the Court and the statements made before the Court. On that occasion, after the matter was argued and when I had expressed my disinclination, learned Counsel for the Applicant had prayed for unconditional withdrawal of that application. Accordingly, permission was granted. 3.

In view of that order, I am not inclined to entertain the present application. The application is dismissed. (SARANG V. KOTWAL, J.)
