Though respondent is duly served, no one appeared on behalf of them when the matter is called out. 3.

By this application, applicant is seeking condonation of 114 days delay in filing first appeal, challenging judgment and award dated 22.9.2014, passed by the Railway claim tribunal, Bombay in O.A.No293/2009.

Considering the submissions made by learned advocate for applicant, reasons disclosed in civil application, I am satisfied that applicant has made out a case for allowing this application.

Hence, the following order.

a) Delay in filing first appeal is codoned.

b) Applicant to remove all office objections in first appeal stamp no.13080/2015 on or before 6.7.2019, failing which, first appeal shall stand dismissed without referring back to the court.

c) If all office objections are removed, matter to appear on board on 12.7.2019 for admission.

d) Civil application stands disposed of.
