The learned APP submits that in the present case i.e. RCC No.629/PW/2016, four witnesses have been examined. It would not be appropriate to consider an application under Section 439 of Cr.P.C. in the midst of the trial. In view of this, the application stands disposed of. 2.

However, the learned Metropolitan Magistrate, 10th Court,Andheri,Mumbai, shall make an endeavour to expedite the recording of evidence, as far as possible, without granting any unwarranted adjournments to the prosecution.
