This Application is moved for condonation of delay of 246 days in filing the First Appeal.

The learned counsel submitted that affidavit of service on respondent nos. 1 and 2 is filed. He submitted that this Appeal is filed against the order of enhancement of award passed by the learned Member, Motor Accident Claims Tribunal, Thane in M.A.C.P No. 511 of 2002. He submitted that the applicant has filed the injury claim, as he has sustained injuries and hence delay is caused. 3.

In view of this submissions, delay of 246 days is condoned. 4.

First Appeal be registered.
