After arguing for some time, when I expressed my disinclination to grant relief in this Application, learned Counsel for the Applicant prays for unconditional withdrawal of this Application. Learned Counsel for the Applicant further prays that the trial be expedited. Considering the prayer, the following order is passed :

ORDER

(i) The Application is allowed to be withdrawn unconditionally. AGP

2/2 29.BA.2056.2021.doc (ii) The Applicant is at liberty to make an appropriate Application before the Trial Court for expediting the trial. (iii)The Trial Court shall consider the Application considering the pendency before that Court and then decide whether the trial can be expedited looking to the facts of the case.

(iv)With these directions, the Application is disposed of accordingly. (v) It is made clear that the Trial Court shall not be infuenced by any of observations made by the Sessions Court in deciding the applicant's bail application earlier.
