The learned counsel for the applicant submits that the application filed by the present applicant was rejected by an order dated 5.10.2016 and this Court had issued specific directions that the learned Sessions Court shall make an endeavour to conclude the recording of substantive evidence within nine month from the date of framing of charge. 2.

The learned counsel for the applicant vehemently submits that till today, the charge has not been framed although the charge-sheet is filed on 6.7.2016. In view of this, taking into consideration the fact that it is a case of under-trial prisoner, the learned Sessions Judge shall make every endeavour to frame charge on or before 10.11.2017. 3.
