This is an application seeking condonation of delay of 275 days in preferring the First Appeal, challenging the impugned Judgment and Decree dated 22nd June 2015 passed by the City Civil Court, Mumbai in Suit No.9574 of 1999.

It is submitted that the notice of this Civil Application has been duly served and the respondent herein has also appeared through the Advocate. However, today none is present on behalf of the respondent. No reply is also filed to this Civil Application for condonation of delay. 1/2 CAF-3822-16.doc

Hence, in view of the reasons stated in paragraph No.2 of the Civil Application, as sufficient cause being made out, it is allowed in terms of prayer clauses (a) and (b).

Office is directed to register and number the First Appeal and place it for admission in due course.
