Heard Mr. Chitale, learned Counsel for the Applicant and Mr. Gaikwad, learned APP for the Respondent-State. 2.

Mr. Chitale, learned Counsel, after arguing the Bail Application for some time, and as the allegation is that the Applicant had murdered a child aged 5 years, the Court is not inclined to grant Bail, seeks withdrawal of the Bail Application. However, he states that the Applicant is incarcerated since 28th March 2018 and till date not a single witness has been examined.

Mr. Gaikwad, learned APP, on instructions, states that effective steps will be taken to conclude the trial expeditiously within a period of one year.

Accordingly, the Bail Application is allowed to be withdrawn with liberty to the Applicant to file a fresh Bail Application after a period of 10 months if there is no substantial progress in the trial. [MADHAV J. JAMDAR, J.]
