1] After arrest on 19/10/2020, applicant came to be chargesheeted in C.R. No. 301/2020 registered with Trombay Police Station for Offences punishable under Sections 313, 376(d), 376(2)(n), 376(b), 377, 498(A), 354(A)(1)(2), 506 r/w 34 of the Indian Penal Code. 2] Case of the prosecution is, victim married to the applicant on 30/04/2018 and thereafter made complainant to have physical relation with his friend Imran Memon on 29/04/2020 and thereafter. 3] Counsel for the complainant informs that complaint lodged is based on mis-directions of co-accused Imran. He would rely on Sulahnama dated 19/05/2020 for the same.
4] In the aforesaid background, in my opinion, case for bail is made out.
(i) Applicant be released on bail in C.R. No. 301/2020 2/3
registered with Trombay Police Station for Offences punishable under Sections 313, 376(d), 376(2)(n), 376(b), 377, 498(A), 354(A)(1)(2), 506 r/w 34 of the Indian Penal Code, upon furnishing P.R. bond in the sum of Rs. 15,000/- with one or more sureties in the like amount.
(ii) Applicant shall neither influence the witnesses nor tamper with evidence in any manner. (iii) Applicant shall attend Investigating Officer as and when directed.
5] Application stands disposed of.
6] In view of disposal of bail application, intervention application also stands disposed of.
