The petitioner has already been terminated from the services with effect from 18th January 2011. The petitioner is praying for protection in view of the judgment in the case of Rakesh S. Dafade Vs. State of Maharashtra & Ors. in Writ Petition No. 3014 of 2004 decided on 4th April 2014.

However, the view taken in the case of Rakesh S. Dafade (Supra) and also the view taken by the Full Bench of this Court in the case of Arun s/o. Vishwanath Sonone Vs State of Maharashtra 1 stand overruled by the Apex Court in the case of Chairman and Managing Director, 2015 (1) Mh.L.J. 457 Shraddha Talekar PS 1/2
