Learned counsel for parties agree that the issues arising in this appeal are squarely covered by the judgment and order dated 22nd September, 2016 in First Appeal No.1954 of 2005 and connected matters.

They submit that in fact even this appeal was to be taken up along with all appeals disposed of by common judgment and order dated 22nd September, 2016. However, this appeal remained aside, and therefore, they submit that this appeal should be disposed of in accordance with the directions in common judgment and order dated 22nd September, 2016.

Accordingly, this appeal is also disposed of in terms of the Pg 1 of 2

p.2.fa.885.2008.doc directions issued in the common judgment and order dated 22nd September, 2016 in First Appeal No.1954 of 2005 and connected matters. This means that the appellant in this case will also be entitled to the enhanced rate of Rs.25/- per square meter along with proportionate statutory benefits and interest. This should be paid to the appellant as per the directions given in paragraph 28 of the common judgment and order dated 22nd September, 2016. The first appeal is disposed of accordingly.
