Heard learned counsel for the petitioner. Learned counsel for the petitioner points out that in this petition what is under challenge is an order passed on a preliminary issue. Pursuant to the filing of this writ petition, the main complaint itself is finally adjudicated. Even the revision filed against the decision of the Labour Court in the complaint is decided. In this light of the matter, learned counsel for the petitioner seeks leave to withdraw this petition with liberty to challenge the final orders passed by

It is made clear that the challenge raised in this petition is kept open and obviously the same can be the subject matter of challenge in the writ petition which may be filed by the petitioner against the orders passed by the Labour and the Industrial Court.
