The above Civil Application was on board yesterday i.e. 15-122016, when at the request of the Learned Counsel Mr. Suhas S. Deokar who said that he had instructions to appear on behalf of the Applicants in place of Mr. Abhay Pande who is the Advocate on record, was adjourned and kept today. When the matter is called out today the Learned Counsel Mr. Suvaaankoor Das states that he has instructions to appear on behalf of the Applicants. He further states that he does not have the vakalatnama of the Applicants, he request that the matter may be adjourned beyond the ensuing Christmas vacation. It is not possible to accede to the said request firstly because yesterday another Learned Counsel had appeared and at his request the matter was kept today on the condition that the matter would be mmj
cao-209-16-(902) proceeded with. Today when the matter is called out another Learned Counsel appears and states that he has now instructions to appear for the Applicants. The above Civil Application has been filed for condonation of delay in a Review Petition. The conduct on the part of the Advocates to say the least is irresponsible and therefore no indulgence can be shown. The Civil Application is therefore rejected for non prosecution on the ground that the Learned Counsel for the Applicants is not in a position to proceed with the matter. In view of the dismissal of the above Civil Application, the Review Petition which suffers from delay does not survive and to stand dismissed as such.
