This is an application under Section 438 of Code of Criminal Procedure for anticipatory bail.

The applicant is apprehending his arrest in Crime No. 82 of 2023 registered at Gandhinagar Police Station, Kolhapur for the ofences punishable under Sections 406 and 420 read with 34 of the Indian Penal Code.

I have heard the learned counsel for the applicant and the learned APP for the respondent / State.

According to the complainant, the present applicant and other co-accused had duped him to the tune of Rs.10 lakhs on the pretext of that they would get his son appointed in Railway Police. It is alleged that similarly the witness Shridhar Shinde was also duped to the tune of Rs.8 lakhs.

The main allegations are against the co-accused Uday Nilkhant and Govind Gurav. No amount was paid to the present applicant. Considering the overall facts and circumstances of the case, I am inclined to release the applicant on anticipatory bail. In the result the following order is passed.

ORDER

A) The Application is allowed.

B) In the event of arrest of the applicant in C.R. No.82 of 2023 registered at Gandhinagar Police Station, Kolhapur for the ofences punishable under Sections 406 and 420 read with 34 of the Indian Penal Code, the applicant be released on bail on executing P.R Bond in the sum of Rs.25,000/- (Rupees Twenty Five Thousand) with one or two sureties in the like amount.

C) The applicant shall attend the concerned police station as and when called by the Investigating Ofcer and shall cooperate in the investigation.
