Heard learned Advocates appearing for the parties in the above Writ Petition and the following order is passed, by consent:- (i) The Divisional Commissioner / State Government, Konkan Division shall hear the Appeal filed by the Petitioner impugning the order dated 23.04.2004 passed by the Managing Officer-cum-SubDivisional Officer, Ulhasnagar within a period of two weeks from today;

(ii) The Divisional Commissioner / State Government, shall hear all the concerned parties and after considering their oral as well as written Corrected / Modified order as per speaking to the minutes of the order dated 31.01.2022 1 of 2

20. civil wp 2345-21-1.doc submissions if any, pass a speaking order strictly on merits and in accordance with law within a period of four weeks from the date of hearing; (iii) The Petitioner will be at liberty to move an Application before the Divisional Commissioner / State Government, Konkan Division for seeking interim protection;

(iv) The order passed by the The Divisional Commissioner / State Government, Konkan Division shall not be implemented for a period of two weeks from the date of service of the same on the parties and / or their Advocates;

(v) All contentions of the parties are kept open. 2.

In view of the above, the Writ Petition is disposed of with liberty to apply.
