Learned APP submitted that, on the basis of a complaint made by Dr. Arun Chandel with similar allegations, the police had registered C.R. No. 554 of 2020 with Kolshewadi Police Station, Kalyan East, District Thane. The statement of Petitioner being a witness, is also recorded in the said crime. That, after completion of investigation of the said crime Police have submitted charge-sheet.

In view thereof, according to us a separate complaint by Petitioner with the same set of allegations as were made by Dr. Arun Chandel, is not necessary.

In view thereof, Mr. Satyanarayan, learned Advocate for Petitioner seeks leave to withdraw the Petition with liberty to file a private 1/2

CAJ 14-Wp-167-2021.odt complaint on the basis of his complaint dated 3rd September, 2020, if so advised and as may be permissible under the provisions of law. Leave and liberty granted.
