The grievance of the Petitioner - Bank that though the Application under Section 14 of the SARFAESI Act is pending before the District Magistrate, Palghar since 27th March, 2018, the same is not so far disposed of.

Proviso to Section 14 of SARFAESI Act mandates that the District Magistrate is required to dispose of Application under Section 14 within 30 days and at the highest within 60 days. Inasmuch as, the Application of the Petitioner is pending since

Rpa 2/2 9-wp-6764-19.doc March 2018, it is expected of the District Magistrate, Palghar to follow the mandates of Section 14 of the SARFAESI Act. We, therefore, direct the District Magistrate, Palghar to decide Application of the Petitioner under Section 14 of the SARFAESI Act, expeditiously and in any event by 24th September, 2019. The Writ Petition to stand disposed of in the above terms.
