Heard the learned counsel for the parties.

This appeal is preferred by defendant no.5 challenging the judgment and decree dated 9.8.2011 passed by Bombay City Civil Court, Mumbai in L.C.Suit No.5732 of 2002.

The learned counsel for the appellant submits that defendant nos.1 to 4 filed First Appeal No.2432 of 2011 and flat purchaser filed First Appeal No.420 of 2012. Both the appeals are already admitted by this court. Considering these facts, following order is Mohite 1/2

b) Appellants to file private paper book within one year from today, failing which the appeal shall stand dismissed without further reference to the court.
