The applicant-wife has filed present application under Section 24 Code of Civil Procedure for transfer of Marriage Petition No.407 of 2013 from the Court of Civil Judge, Senior Division, Sangli to the Family Court at Bandra, Mumbai. The applicant claims to be presently residing at Mumbai. Admittedly, the parties have a child aged about 3 years, whose custody is with the applicant. The applicant claims that it is difficult for her either to leave the child at Mumbai for attending to the court at Sangli or to carry the child along with her. Considering this specific difficulty, in my opinion, it would be in the interest of justice to

Dusane 2/2 MCA126.2014 allow the application and transfer the proceedings from the Court of Civil Judge, Senior Division, Sangli to the Family Court at Bandra, Mumbai. The application is allowed in terms of prayer clause (a).
