Mr. Arote, learned Counsel for the applicant, informs that out of matrimonial discord, offence being Crime No.74 of 2019 came to be registered which is punishable under Sections 498-A, 323, 406, 504, 506 read with Section 34 of the Indian Penal Code.

According to him, the husband and wife have agreed for divorce by mutual consent and accordingly proceedings vide Lodging No.1704 of 2021 are initiated before the Family Court,

Rane 2/2 ABA-939-2019 (SR.5) 22.7.2021 Bandra. It is further informed that, out of one time alimony of Rs.8,00,000/- as was agreed, Rs.6,00,000/- is already paid by the applicant.

In the aforesaid background, learned APP does not press for custody of the applicants.
