Mr.Kadam, learned Counsel, having taken instructions from the Petitioner, who is present in the Court, seeks leave to withdraw the petition with liberty (1) to file a protest petition before the concerned Magistrate in respect of Jayesh Ravlekar and Ashok Kashid as report under Section 169, so far as these persons are concerned, prosecution proposes to file, (2) to file an application under Section 216 and / or Section 319 of Cr.P.C., as and when occasion arises. Leave with liberty as prayed for is granted. The petition is dismissed as withdrawn.

At this stage, Mr.Yagnik, having taken instructions from the officer concerned, makes a statement that so far as C.R.No.I-39/2014 filed against the Petitioner in Thane is concerned, investigation officer will make NC final. Statement is accepted.
