The appellant herein had challenged the order dated 17.01.2015 in MACP 2736 of 2012, whereby the learned Member, MACT, Mumbai had allowed the application under Section 140 of the Motor Vehicles Act. The learned Counsel for the appellant states that subsequent to filing of this appeal, the claim petition has been disposed on 10.12.2018. The appellant intends filing appeal against Salgaonkar

In the light of the above, this appeal has rendered infructuous, and hence disposed of.

Civil application stands disposed of in view of disposal of the appeal. It is made clear that I have not gone into the merits of the matter.

All points and contentions are kept open, in the appeal proposed to be filed against the judgment and award dated 10.12.2018.
