1] The applicant is apprehending arrest in CR No.352 of 2016 dated 9.9.2016 registered with Dahisar Police Station, Mumbai under Sections 307, 498A, 406, 323, 504, 506 read with 34 of the Indian Penal Code. 2] The first information is lodged by Smt. Manpreet Kaur Chandok. The applicant is sister-in-law of the first informant. The applicant is married and residing separately at Nashik. Prima facie it appears from the record that there are general allegations made against the applicant. The allegations qua the husband of the first informant are serious in nature. In view of the ratio laid down by the Supreme Court in the case of Arnesh Kumar Vs. State of Bihar [(2014) 8 SCC 273], the applicant deserves to be released on pre-arrest bail.
Dond aba.795-2017.sxw 3] In view of the above, the applicant is granted pre-arrest bail. Hence, the following Order:
(i) In the event of arrest in CR No.352 of 2016 registered with Dahisar Police Station, Mumbai, the applicant shall be released on bail on her furnishing PR bond of Rs.15,000/- with one or two local sureties.
(ii) The applicant shall attend the Investigating Officer as and when called for between 10.00 a.m. to 12.00 noon. The Investigating Officer shall not detain the applicant on any count after 12.00 noon. It is needless to mention that, before calling the applicant to the concerned police station, the Investigating Officer shall issue notice under Section 160 of Cr. P.C. specifying the date and aforestated time. (iii) The applicant shall not tamper with the evidence and/or influence the prosecution witnesses.
