The applicant apprehends arrest in C.R.No.143 of 2023 registered with Borivali Police Station, Mumbai for offences punishable under Section 323, 406, 498A, 504, 506 r/w. 34 of the Indian Penal Code. 2.
Heard learned Counsel for the Applicant, learned APP for the State. I have perused the records and considered the submissions advanced by the learned Counsel for the respective parties . 3.
The marriage of the applicant and the first informant was solemnized on 22.04.2018. They are living separately since 25.06.2022. The first informant lodged the FIR on 2.3.2023 alleging that since the date of the marriage the applicant and his family members were
demanding dowry and subjected her to cruelty. 4.
The records prima facie indicate that there is matrimonial dispute between the applicant and the first informant. Considering the nature of accusation, the applicant was granted interim protection. 5.
Learned APP states that the applicant has been interrogated. He has co-operated with the investigation and his presence is not required for custodial interrogation. In the light of the said statement, and considering the nature of the accusation, the application is allowed on the following terms and conditions:- (i) In the event of arrest of the Applicant in Crime No.143 of 2023 registered with Borivali Police Station, Mumbai, the Applicant be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twentyfive Thousand Only) with one or two sureties in the like amount; (ii) The Applicant shall report to the Investigating Officer as and when required by the Investigating Officer.
(iii) The Applicant shall keep the Investigating Officer informed of his current address and mobile/contact details, and/or change of residence or mobile/contact details from time to time.
(iv) The Applicant shall not interfere with the Complainant and the other witnesses, or tamper with the evidence in any manner. .
Application stands disposed of.
