4-IA-1305-2020.doc has been convicted of an offence punishable under section 138 of the Negotiable Instruments Act by the learned Judicial Magistrate, Cantonment Court Pune on 18th September, 2015. An appeal bearing Criminal Appeal No.539 of 2015 preferred by him before the learned Sessions Judge, Pune came to be dismissed on 15th November, 2019 against which the accused has approached this Court by way of a revision.

After hearing the learned Counsel for the applicant/complainant, his prayer to withdraw an amount of Rs.3,00,000/- deposited by the accused in the trial Court is granted. In case the revision of the accused is allowed, the applicant-complainant shall have to repay the amount to the accused.
