Heard learned counsel for the Applicant.

The Applicant has been convicted for the offences punishable under Sections 279, 338, 304A of the Indian Penal Code and under Section 184 of the Motor Vehicles Act. The Applicant has

been sentenced to suffer S.I. for one month and to pay a fine of Rs.1,000/-, in default to undergo S.I. for one month for the offence punishable under Section 279 of the Indian Penal Code; to suffer S.I. for one month and to pay a fine of Rs.1,000/-, in default to undergo S.I. for one month for the offence punishable under Section 338 of the Indian Penal Code; to suffer S.I. for one year and to pay a fine of Rs.5,000/-, in default to undergo S.I. for two months for the offence punishable under Section 304A of the Indian Penal Code; and to pay a fine of Rs.500/-, in default to undergo S.I. for 10 days for the offence punishable under Section 184 of the Motor Vehicles Act.

Learned counsel for the Applicant submits that the Applicant was on bail pending trial and appeal. He submits that the Applicant has not misused the liberty granted to him.

Learned counsel for the Applicant states that the Applicant has deposited the fine amount. If the said fine amount is not deposited, the same shall be deposited within two weeks from today in the Registry of the trial Court. Accordingly, the Application is allowed & the Applicant's sentence is suspended pending the final disposal of this Application on the following terms & conditions;

O R D E R

(i) The Applicant is enlarged on bail on his furnishing P.R.Bond in the sum of Rs.15,000/- with one or two solvent sureties in the like amount in the trial Court.

Accordingly, the Application is disposed of.
