When the above Family Court Appeal is called out, the parties have informed the Court that the disputes in the above Appeal have been settled as recorded in the Consent Terms dated 24th August, 2023. The Consent Terms inter alia provide that the Appellant and the Respondent accept the judgment and decree
passed by the Family Court, Solapur in Petition A-142 of 2016 dated 9th March, 2018. In other words, the Appellant and the Respondent confirm that the marriage has been dissolved by the said judgment and decree. The Consent Terms also provide that the Respondent has paid Rs.14 Lakhs as a one time alimony to the Appellant which the Appellant admits and confirms. In view of this payment, the Appellant has also vacated the premises in Solapur more particularly described in paragraph 3 of the Consent Terms.
The Consent Terms have been signed by the Appellant as well as the Respondent. The Appellant wife as well as the Respondent husband are both present in Court today. They have both stated that they have signed the Consent Terms of their own free volition and after reading and understanding the same as well as the implications thereof. The Consent Terms are also signed by the advocates for the Appellant and the advocates for the Respondent.
In these circumstances, the Consent Terms dated 24th August, 2023 are taken on record and marked "X" for identification. There shall be an order and decree in terms of the
Consent Terms and the above Family Court Appeal is also disposed of in terms thereof. No order as to costs. In view of the disposal of the Family Court Appeal, nothing survives in the above Civil Application and the same is disposed of.
This order will be digitally signed by the Private Secretary/ Personal Assistant of this Court. All concerned will act order.
