By this application, the applicant seeks condonation of delay of 17 days in filing the present arbitration appeal. 2.

I have heard the learned counsel appearing for the respondents and have perused the affidavit filed by the applicant explaining the delay of 17 days. In the affidavit, it was alleged that the Head Office of the applicant at Chennai referred the matter and decided to prefer the appeal. The learned advocate for the applicant is practicing in Mumbai. In my view, the applicant has sufficiently explained the delay of 17 days in filing the arbitration appeal. The applicant has made out a case for condonation of delay of 17 days in filing the appeal. 3.

Civil application is accordingly made absolute in terms of prayer clause (a). Delay of 17 days in filing the arbitration appeal is condoned. Civil application is disposed of in aforesaid terms. No order as to costs.

Place the arbitration appeal on board for 'Admission' on 2nd December 2016.
