The grievance of the petitioner is that both his children should be transferred at one and the same school for admission under the provisions of the Right of Children for Free and Compulsory Education Act, 2009, at the Respondent No.3-School. In view of the circular dated 19 January 2024 issued by the said school, it was informed that for undertaking renovation work at the school at Kopari, Vashi, the students would be transferred to schools at Sector-14 and Sector-1 of Kopar, Khairane. The students from grades I to IV were transferred at 1/2 Kiran Kawre

911-WP-5810-2024.doc Sector-14 while students from grades V to VIII were to be transferred to Sector-1. Since the children of the petitioners are studying in grade I and grade VI, the petitioner's grievance is that both the children should be transferred at one and the same school. 2.

Under Section 32 of the Act of 2009, the Education Officer (Primary) has jurisdiction to entertain any grievance with regard to Right of Children under the Act. We, accordingly, direct the respondent No.2 to treat the present Writ Petition as a representation made under Section 32 of the said Act, and take steps to redress the same within a period of one week from receiving copy of this order. 3.
