This is the subsequent application seeking enlargement on bail. Earlier application was rejected by this Court on 21/9/2016. According to the learned Counsel for the applicant, subsequently, coaccused Parmeshwardin Pal was enlarged on bail by order dated 12/1/2018 and therefore, the applicant seeks bail by virtue of doctrine of parity. Learned APP submits that the trial has commenced and the prosecution has recorded substantive evidence of 6 witnesses till today. In view of this, the application under section 439 of the Code of Criminal Procedure, 1973 need not be considered in the midst of the trial. The application being sans merits stands rejected and disposed of accordingly.
